Construction Worker Injured in 15-Foot Fall in Long Beach, CA
According to recent news reports from Long Beach, California, a 40-year-old construction worker fell approximately 15 feet into an excavation pit near Seventh St. on Monday, Jan. 10 around 11 a.m. He had apparently been crossing a concrete beam and lost balance, resulting in the fall. The worker lost consciousness for a time. The Long Beach Fire Department responded in a few minutes and hoisted the injured worker out of the pit on a stretcher. The injured construction worker experienced neck and back injuries, but none were expected to be life-threatening.

When almost any type of construction site accident occurs, local authorities, and often the Occupational Safety and Health Administration (OSHA), will conduct investigations in order to ensure that worker safety was considered at all times. An employer can sometimes bear liability for an accident based on many different factors, such as lack of adequate training, failure to provide safety equipment, failure to maintain safety equipment, or negligent hiring practices. Other workers or people on-site will likely also be questioned in order to determine if any negligent behavior may have gone on that could have contributed to the accident. Despite the seeming straightforward narrative of the news article, there can often be many more issues that may have contributed to such an accident. Consequently, an independent investigation may be conducted in order to ascertain what happened.

The New York Supreme Court took up this issue on April 8, 2010 in Gaspar v. LC Main LLC, 113198/07. The general contractor had contracted with a company, Pro Safety, to be the project safety consultant. Among other things, it had a contractual duty to daily monitor the site to identify safety hazards.
